Mediation an Effective Method for Appling Restorative Justice

| Introduction: Mediation is an informal way of settling a dispute without relying on a legal judgment issued by a judge. The parties involved in mediation meet with a neutral third party to reach a mutually agreeable solution that will end a conflict. Parties are not forced to agree to a solution in mediation. Rather, the mediator facilitates communication to help the parties reach a mutual agreement. In this article, a case of mediation has been reported. Case: A conflict between two cousins in a village in the west of Iran occurred in autumn of 2003. Some days later one of the cousins was killed by the other. Intervention: Mediation techniques in four phases of referring, Preparedness, Discussion and Follow up and Sustaining the Results used for conflict resolution between two families. Conclusion: Conflict resolution between two families and rebuilding their relations were the main goals of mediation in this case. Mediation in social work is a very useful method for conflict resolution. It is so important to study the cultural characters of two parties and select and use the local methods of mediation to make the results sustainable. Khoon-Solh was one of these potentials in the west of Iran which the mediator used it successfully. |
